Vira Power, Inc. ("VIRA," "we," "us," or "our") respects your privacy and is committed to protecting the personal information entrusted to us.

This Privacy Policy explains how Vira Power, Inc. collects, uses, discloses, stores, and protects personal information when you:

  • Visit VIRA websites, including viragrid.co;

  • Download, register for, access, or use the Band V mobile application, including its Android and iOS versions;

  • Create or maintain a Band V account;

  • Use VIRA's software, energy-management, distributed energy resource, digital twin, or related technology services;

  • Participate in a VIRA program, pilot, or energy service;

  • Communicate or interact with VIRA; or

  • Otherwise use a VIRA product or service.

Together, these websites, applications, products, and services are referred to in this Privacy Policy as the "Services."

About VIRA and Band V

Band V is a mobile application provided by Vira Power, Inc. Band V enables users to access and manage energy-related services and may allow users to view electricity consumption, meter and energy information, manage their account, interact with connected energy equipment, make or review energy-related transactions, and access other functionality made available by VIRA.

VIRA is the commercial brand used by Vira Power, Inc. References in this Privacy Policy to "VIRA," "we," "us," or "our" refer to Vira Power, Inc. unless we expressly state otherwise.

Vira Power, Inc. may operate through subsidiaries, affiliates, service providers, and local partners in the markets in which we provide our Services. In Nigeria, these entities include VIRA Grid Nigeria Limited, an affiliated Nigerian company that may support VIRA's local operations and provision of Services.

The involvement of an affiliate or service provider does not, by itself, mean that the entity independently determines how your personal information is used. Unless we tell you otherwise in connection with a particular Service, Vira Power, Inc. is responsible for the privacy practices described in this Privacy Policy.

Where another VIRA entity is legally required to act as a data controller or otherwise has independent responsibilities for particular processing activities under applicable law, we will provide any additional information or notices required by law.

Scope of This Privacy Policy

This Privacy Policy applies to personal information processed through the Services, including information collected through the Band V mobile application.

For Band V users, this includes, as applicable, account and profile information, electricity and meter information, energy usage and transaction information, device and application information, and crash and diagnostic information. Additional details about the information collected through Band V and how it is used are provided below.

This Privacy Policy does not apply to third-party websites, applications, products, or services that VIRA does not control, even if they are linked to or accessible through our Services. Those third parties may have their own privacy policies and data-handling practices.

By using the Services, you acknowledge the practices described in this Privacy Policy. Where applicable law requires consent for particular processing activities, VIRA will request that consent separately.

1. Information We Collect

The information we collect depends on how you interact with VIRA and which Services you use.

Information You Provide to Us

We may collect information you provide directly to us, including:

  • Contact information, such as your name, email address, telephone number, company, job title, and address.

  • Account information, such as login credentials, account preferences, and user profile information.

  • Property or service information, such as property type, service location, electricity provider, meter information, and information about energy equipment installed at a property.

  • Program and application information provided when you join a waitlist, request a demonstration, participate in a pilot, register an energy asset, or apply to participate in a VIRA program.

  • Billing and transaction information necessary to administer payments, credits, subscriptions, energy services, or other commercial transactions.

  • Communications you send to us, including inquiries, support requests, feedback, survey responses, and other correspondence.

Energy, Meter, and Equipment Data

When you use certain VIRA energy services, we may collect information from or about electricity meters, solar systems, batteries, inverters, gateways, controllers, and other distributed energy resources ("DERs").

Depending on the service, this information may include:

  • Electricity consumption and generation;

  • Import and export of electricity;

  • Meter readings and interval data;

  • Battery state of charge and operating status;

  • Solar generation;

  • Equipment status, alarms, and diagnostics;

  • Power, voltage, current, frequency, and other electrical measurements;

  • Equipment identifiers, models, configurations, and firmware information; and

  • Historical and real-time operating data.

This information may be obtained directly from VIRA equipment, third-party equipment, application programming interfaces (APIs), electricity distribution companies, energy service providers, equipment manufacturers, or other authorized sources.

Grid, Location, and Digital Twin Data

Certain VIRA services use information about the physical and electrical characteristics of electricity networks.

We may collect or process information relating to:

  • Service locations and geographic coordinates;

  • Electricity feeders, transformers, substations, meters, and other grid infrastructure;

  • Electrical network topology and connectivity;

  • Equipment ratings and technical characteristics;

  • Distributed energy resources connected to the grid; and

  • Simulated or modeled grid conditions.

Some of this information may be used to create digital models or "digital twins" of electricity networks for planning, analysis, simulation, forecasting, and optimization.

Not all grid or equipment data constitutes personal information. However, where such information can reasonably be associated with an identifiable person, household, or account, we handle it in accordance with this Privacy Policy and applicable law.

Information Collected Automatically

When you use our websites, applications, or online Services, we may automatically collect certain technical information, including:

  • IP address;

  • Browser and device type;

  • Operating system;

  • Device identifiers;

  • Pages or features accessed;

  • Dates and times of access;

  • Referring pages;

  • Approximate location derived from an IP address; and

Band V Mobile Application

This Privacy Policy also applies to the Band V mobile application, including versions of the application made available for Android and iOS.

When you create or use a Band V account, we may collect and process information necessary to provide the application's energy-management, account, payment, and related services.

Band V Account Information

When you register for or use Band V, we may collect information such as:

  • Your name;

  • Email address;

  • Telephone number;

  • Account and authentication information;

  • Property or service location;

  • Electricity account or meter information;

  • Account preferences and settings; and

  • Information you provide when contacting VIRA for support.

Energy and Meter Data

Band V may receive information from electricity meters, gateways, batteries, solar systems, inverters, or other energy equipment associated with your account.

Depending on the equipment and services connected to your account, this may include:

  • Electricity consumption;

  • Electricity generation;

  • Electricity imported from or exported to the grid;

  • Meter readings and interval data;

  • Battery state of charge;

  • Solar generation;

  • Equipment operating status;

  • Power, voltage, current, frequency, and related electrical measurements; and

  • Equipment identifiers, configurations, alarms, and diagnostic information.

We use this information to provide Band V functionality, display energy information to you, operate and optimize participating energy resources, calculate applicable energy charges or credits, diagnose equipment or service issues, and improve our energy services.

Device and Application Information

When you use Band V, we may automatically receive certain information about your device and application, including:

  • Device type and model;

  • Operating system and operating-system version;

  • Application version;

  • Device or application identifiers;

  • IP address;

  • Language and application configuration;

  • Application activity and technical events; and

  • Information necessary to maintain the security and performance of the application.

We use this information to operate Band V, maintain account and application security, troubleshoot technical problems, understand application performance, and improve the reliability of our Services.

Crash Reports and Diagnostics

Band V uses Sentry, a third-party application monitoring and error-reporting service, to help VIRA identify crashes, software errors, performance problems, and other technical issues.

When Band V encounters an error or performance issue, diagnostic information may be transmitted to Sentry. Depending on the event, this information may include:

  • Crash logs;

  • Error messages and technical stack traces;

  • Application version;

  • Operating-system and device information;

  • Performance and diagnostic information; and

  • Technical information about the circumstances surrounding an application error.

VIRA configures Sentry so that personally identifiable information is not sent by default (sendDefaultPii: false). Crash and diagnostic information collected through this configuration is not intended to be linked to your Band V identity.

We use this information for application stability, troubleshooting, security, performance monitoring, and improvement of Band V.

Account Deletion

You may request deletion of your Band V account and associated personal information through our public Band V Account Deletion page at:

You do not need to log in to Band V to submit an account-deletion request.

The account-deletion page explains the categories of information that are deleted or anonymized when an account is closed, the records VIRA may be required to retain, and the applicable retention periods.

2. How We Use Information

We may use information we collect to:

  • Provide, operate, maintain, and improve the Services;

  • Create and manage user accounts;

  • Provide energy services and administer VIRA programs;

  • Monitor electricity consumption, generation, storage, and export;

  • Monitor and manage participating energy equipment and DERs;

  • Calculate energy charges, credits, payments, or other transactions;

  • Perform grid modeling, digital-twin simulations, capacity analysis, and network planning;

  • Forecast electricity demand, generation, equipment performance, or grid conditions;

  • Optimize the operation and coordination of energy resources;

  • Identify equipment faults, abnormal conditions, or service issues;

  • Provide reports, dashboards, analytics, recommendations, and insights;

  • Conduct research and develop new products, models, algorithms, and services;

  • Communicate with you about your account, Services, programs, or inquiries;

  • Provide technical and customer support;

  • Protect the security and integrity of our systems;

  • Detect, investigate, and prevent fraud, misuse, or unlawful activity;

  • Comply with legal, regulatory, contractual, and reporting requirements; and

  • Carry out other purposes disclosed to you at the time information is collected.

Where permitted by law, we may also aggregate or de-identify information so that it can no longer reasonably identify an individual. We may use such aggregated or de-identified information for analytics, research, grid planning, product development, benchmarking, forecasting, and other legitimate business purposes.

3. Artificial Intelligence, Analytics, and Automated Systems

VIRA may use data analytics, optimization algorithms, machine learning, artificial intelligence, and other computational methods in connection with our Services.

These technologies may be used to analyze energy usage, forecast electricity demand or generation, identify patterns or anomalies, optimize distributed energy resources, simulate grid conditions, or support operational and planning decisions.

Where required by applicable law, we will provide appropriate disclosures or safeguards regarding automated processing that produces legal or similarly significant effects on individuals.

4. How We Share Information

We may share information with third parties where necessary to operate our business and provide the Services.

These parties may include:

Service Providers

We may share information with vendors and service providers that perform services on our behalf, such as cloud hosting, data storage, software development, communications, analytics, cybersecurity, customer support, and payment processing.

Electricity and Energy Partners

Where necessary to provide a VIRA program or energy service, we may share relevant information with electricity distribution companies, utilities, independent power producers, distributed energy resource operators, equipment providers, energy service companies, or other program partners.

For example, information about electricity imports, exports, or equipment performance may need to be exchanged with a participating electricity distribution company to administer an energy program.

Business Customers and Partners

Where VIRA provides software, analytics, digital-twin, or grid-management services to an organization, information may be made available to authorized users of that organization in accordance with our agreement with that organization.

Professional Advisers

We may disclose information to lawyers, accountants, auditors, insurers, consultants, and other professional advisers where reasonably necessary.

Legal and Regulatory Requirements

We may disclose information where we reasonably believe disclosure is required to:

  • Comply with applicable law, regulation, court order, or legal process;

  • Respond to lawful requests from regulators or government authorities;

  • Protect the rights, property, or safety of VIRA, our users, or others; or

VIRA does not sell personal information for monetary consideration.

11. Nigeria Privacy Rights

Where the Nigeria Data Protection Act 2023 and other applicable Nigerian data protection requirements apply, VIRA processes personal data in accordance with applicable requirements concerning lawful processing, transparency, data minimization, security, data-subject rights, and international data transfers.

Individuals in Nigeria may also have the right to lodge a complaint with the Nigeria Data Protection Commission (NDPC) regarding the processing of their personal data.

Where permitted by law, we may also send information about VIRA products, programs, events, or other updates that we believe may be relevant to you.

In some circumstances, VIRA processes personal information on behalf of an electricity distribution company, energy provider, business customer, program partner, or other organization.

Where VIRA processes personal information solely on behalf of another organization, that organization may be responsible for determining how and why the information is processed. In those circumstances, requests concerning your personal information may need to be directed to that organization.

We may update this Privacy Policy periodically to reflect changes to our Services, business practices, technology, or applicable law.

When we make changes, we will update the Last Updated date at the top of this Privacy Policy. If changes are material, we may provide additional notice where appropriate or required by law.
